Welcome to SplashyRadio (splashyradio.com and related apps), operated by SPLASHYSTUDIOS LLC (“we,” “us,” or “our”).

SplashyRadio is a live streaming station and music discovery surface for SplashyRecords releases. By accessing or using SplashyRadio — including the website, progressive web app (PWA), playback features, song pages, sponsorship surfaces, and related notifications — you agree to these Terms.

If you do not agree, do not use SplashyRadio.

1. What SplashyRadio Is

SplashyRadio provides:

• a live, scheduled radio-style stream of SplashyRecords music and station promos
• public song pages with artwork, lyrics (when available), and playback
• optional account features such as push notifications for new releases
• sponsorship opportunities for brands that want to support the station

SplashyRadio is an entertainment and promotion product. It is not a download storefront, music ownership marketplace, or substitute for licensed streaming platforms where SplashyRecords releases may also appear after their store release dates.

Related community and business tools under The Splash Club / SplashyPages may link to SplashyRadio but are covered by their own product terms where applicable.

2. Listening & Acceptable Use

You may listen for personal, non-commercial enjoyment.

You agree not to:

• scrape, rip, rebroadcast, mirror, or redistribute the live stream or track audio without our written permission
• bypass technical limits, DRM-like controls, or access controls
• interfere with playback, scheduling, analytics, or other listeners
• use bots or automation to inflate listenership, reactions, or notification engagement
• use SplashyRadio to harass anyone or to distribute illegal content

We may throttle, block, or terminate access that harms the station or other users.

3. Accounts (Optional)

Some features (for example, new-release push notifications) may require an account.

• Provide accurate information and keep credentials secure
• You are responsible for activity under your account
• One person should not run multiple accounts to manipulate notifications, leaderboards, or related systems

You must be at least 18 years old to create an account.

4. Music, Lyrics & Intellectual Property

• SplashyRecords / SPLASHYSTUDIOS LLC (and our licensors) own or control the music, artwork, branding, station imaging, and most on-site content
• Synced lyrics and share videos are provided for promotional listening and sharing as we enable them — not as a grant of ownership
• You may not claim ownership of SplashyRadio audio, artwork, or branding
• “Share” / download features (when offered) are for personal promotional use consistent with these Terms; they do not grant commercial sync, master, or publishing rights

If you believe content on SplashyRadio infringes your rights, contact team@splashystudios.com with enough detail for us to investigate.

5. Song Pages, Release Dates & Streaming Links

Song pages may show store release dates and third-party streaming destinations (such as Apple Music, Spotify, or YouTube Music).

• Release dates and availability can change
• Third-party services have their own terms; we are not responsible for their catalogs, pricing, or availability
• “Exclusive on SplashyRadio” messaging applies only to the period and scope we describe on the site — it does not create a perpetual exclusive unless we say so in writing

6. Sponsorships & Promotions

Station sponsorships, ads, and promo reads are commercial arrangements. Deliverables, timing, and creative approval are defined in the sponsorship order or agreement. We may refuse or remove sponsorships that conflict with station standards or applicable law.

7. Notifications & Installable App

If you enable notifications or install the PWA:

• you can revoke notification permission in your device or browser settings at any time
• notification delivery is not guaranteed (OS, browser, and network conditions vary)
• “Next track” style alerts (when offered) are local device notifications; new-release alerts may use web push tied to your account preferences

8. Availability

SplashyRadio is provided as-is. Live scheduling, gapless playback, background audio, and lock-screen controls depend on your device and browser. We do not guarantee uninterrupted uptime, perfect sync across listeners, or permanent availability of any particular recording.

9. Privacy

Our Privacy Policy explains what we collect and how we use it when you use SplashyRadio.

10. Disclaimers & Limitation of Liability

To the fullest extent permitted by law:

• SplashyRadio is provided without warranties of merchantability, fitness for a particular purpose, or non-infringement
• We are not liable for indirect, incidental, special, consequential, or lost-profit damages arising from your use of SplashyRadio
• Our total liability for any claim relating to SplashyRadio is limited to the greater of (a) amounts you paid us for SplashyRadio features in the 12 months before the claim, or (b) USD $50

Some jurisdictions do not allow certain limitations; in those places, our liability is limited to the maximum extent allowed.

11. Termination

We may suspend or end access to SplashyRadio (or related accounts) for violations of these Terms, abuse, legal risk, or operational need. You may stop using SplashyRadio at any time.

12. Changes

We may update these Terms as SplashyRadio evolves. Continued use after changes means you accept the updated Terms. The “Last Updated” date above will change when we revise this page.
